Overview
Welcome to TheNerv. "We", "us" and "our" refer to TheNerv. We run this online store at thenerv.in, including all related information, content, features, tools, products and services (the "Services"). TheNerv is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service ("Terms"), together with our Privacy Policy, Refund Policy and Shipping Policy, describe your rights and responsibilities when you use the Services. By visiting, browsing or buying from our store, you agree to these Terms. If you don't agree, please don't use the Services.
1. Eligibility and your account
You must be at least 18 years old, or use the Services under the supervision of a parent or guardian. You agree to give correct, current and complete information (name, phone number, address, email) when you place an order. You are responsible for keeping your account login safe and for all activity on your account.
2. Our products
We try to show our products as accurately as possible. Colours and appearance may look slightly different on your screen depending on your device. Some products, such as drones, RC vehicles and gadgets, must be used as per their instructions and any applicable local laws and rules, including drone rules where they apply. You are responsible for using products safely and lawfully. Product descriptions, availability and specifications may change without notice, and we may limit quantities per customer.
3. Orders
Placing an order is an offer to buy. An order is confirmed only once we accept it, and we may refuse or cancel an order, for example if a product is out of stock, there's a pricing or listing error, the address isn't serviceable, or we suspect fraud. For Cash on Delivery orders we may call or message to confirm before dispatch. If we cancel a prepaid order, you'll receive a full refund.
4. Prices and payment
All prices are in Indian Rupees (₹) and include applicable taxes unless stated otherwise. Standard shipping is free; any other charges, such as a COD fee, are shown at checkout. Prices and offers may change without notice, but the price you pay is the price shown when you place your order. We accept UPI, debit/credit cards, net banking, wallets and Cash on Delivery. You confirm that you are authorised to use the payment method you choose.
5. Shipping and delivery
We ship across India. Delivery timelines are estimates and may be affected by courier delays or events outside our control. Please check our Shipping Policy for details.
6. Cancellations, returns and refunds
Orders can be cancelled only before dispatch. Returns are accepted within 7 days of delivery for manufacturing defects only, and approved refunds are processed within 4–5 business days. Warranty, where offered, is as stated on each product page. Full details are in our Refund Policy.
7. Intellectual property
All content on the Services, including the TheNerv name and logo, text, images, graphics, videos and design, belongs to TheNerv or its licensors and is protected by Indian and international intellectual property laws. You may use the Services for personal, non-commercial purposes only. You may not copy, reproduce, republish or use our content without our written permission. Other brand names shown on the site belong to their respective owners.
8. Reviews and feedback
If you send us reviews, photos, ideas or other feedback, you allow us to use, reproduce and display it, including in marketing, without payment. Your feedback must be genuine, lawful and must not infringe anyone's rights. We may remove content that we find false, offensive or unlawful.
9. Prohibited use
You agree not to use the Services for any unlawful purpose, to place fake or fraudulent orders, to resell products commercially without our consent, to harass anyone, to upload viruses or malicious code, to scrape or copy the site, or to interfere with its security or operation. We may suspend or block access if these Terms are broken.
10. Third-party tools and links
The Services may include third-party tools (such as payment, tracking or review tools) and links to other websites. We don't control them and aren't responsible for their content, policies or practices.
11. Relationship with Shopify
TheNerv is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with TheNerv. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and TheNerv, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with TheNerv.
12. Privacy
Your personal data is handled as described in our Privacy Policy. Certain data may also be processed by Shopify under the Shopify Consumer Privacy Policy.
13. Errors and inaccuracies
Occasionally the site may contain typing errors or inaccuracies in product descriptions, prices, offers or availability. We may correct them and update or cancel affected orders, even after you've placed them. If we cancel a prepaid order for this reason, you'll get a full refund.
14. Disclaimer
Except for the warranty stated on each product page and your rights under the Consumer Protection Act, 2019, the Services and products are provided "as is" and "as available". We don't guarantee that the website will always be uninterrupted or error-free.
15. Limitation of liability
To the extent permitted by law, TheNerv will not be liable for any indirect, incidental or consequential loss arising from your use of the Services or products, including loss caused by misuse, unsafe use or not following product instructions. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits your statutory rights as a consumer.
16. Indemnity
You agree to indemnify TheNerv and Shopify against claims, losses or costs arising from your breach of these Terms, your misuse of the Services or products, or your violation of any law or third-party rights.
17. Governing law and disputes
These Terms are governed by the laws of India. Please contact us first; most issues can be sorted out quickly. Any dispute that can't be resolved amicably will be subject to the exclusive jurisdiction of the courts at Gautam Buddh Nagar (Noida), Uttar Pradesh, without affecting your right to approach a consumer commission under the Consumer Protection Act, 2019.
18. General
If any part of these Terms is found invalid, the rest will still apply. Our not enforcing a right is not a waiver of it. These Terms are the entire agreement between you and us about the Services. You may not transfer your rights under these Terms; we may assign ours.
19. Changes to these Terms
We may update these Terms from time to time. The latest version will always be on this page, and continued use of the Services means you accept the changes.
