TheNerv ("we", "us", "our") runs this online store at thenerv.in. This Privacy Policy explains what personal data we collect when you browse, buy from or contact us, why we collect it, who we share it with, and the choices you have. We process personal data in line with the Digital Personal Data Protection Act, 2023, the Information Technology Act, 2000 and the rules made under them.

By using our website or placing an order, you agree to the practices described here. If you don't agree, please don't use the site.

What we collect

  • Contact and order details: your name, phone number, email address, billing and shipping address.
  • Payment details: payment method and transaction status. Card, UPI and bank details are entered directly with our payment partners. We do not see or store your full card number or UPI PIN.
  • Account details: your login, preferences and order history if you create an account.
  • Order activity: products you view, add to cart, buy, return or cancel.
  • Messages: what you send us by email, phone, WhatsApp, chat or social media, including photos or videos shared for a return or warranty claim.
  • Device and usage data: IP address, device and browser type, pages visited and how you got to our site, collected through cookies and similar technologies.

Why we use it

  • To process, confirm, ship and deliver your orders, including verifying Cash on Delivery orders
  • To handle returns, refunds, replacements and warranty claims
  • To send order updates by SMS, WhatsApp or email
  • To answer your questions and give customer support
  • To send offers and product news, only where you've opted in. You can opt out at any time
  • To improve our website, products and ads, and to understand what customers like
  • To prevent fraud, misuse and fake orders, and to keep the site secure

Who we share it with

We never sell your personal data. We share only what's needed with:

  • Payment partners that process online payments
  • Courier and logistics partners that pick up and deliver your orders
  • Messaging, email and support tools we use to contact you
  • Analytics and advertising partners such as Google and Meta, which help us measure and show ads. These partners may use cookies under their own privacy policies
  • Government or law enforcement authorities, when required by law or to protect our rights, customers or the public

Cookies

We use cookies to keep your cart working, remember your preferences, understand site traffic and show relevant ads. You can block or delete cookies in your browser settings, though some parts of the site (like the cart and checkout) may not work properly without them.

How long we keep it

We keep your data only as long as needed to fulfil your orders, provide warranty support, resolve disputes and meet legal, tax and accounting requirements. After that, it is deleted or anonymised.

Keeping it safe

Our store runs on Shopify's secure, encrypted (HTTPS) platform, and payments are handled by PCI-DSS compliant partners. We limit access to your data to people who need it to serve you. No system is completely secure, so please don't share passwords or OTPs with anyone, including someone claiming to be from TheNerv.

Your rights

Under Indian law, you can:

  • Ask what personal data we hold about you and how it is used
  • Ask us to correct, complete or update your data
  • Ask us to delete your data, unless we must keep it by law
  • Withdraw consent for marketing at any time, using the unsubscribe link or by contacting us
  • Nominate another person to exercise these rights on your behalf in case of death or incapacity
  • Raise a grievance with us, and if unresolved, with the Data Protection Board of India

Children

Our site is meant for adults. If you are under 18, please use the site and place orders with the involvement of a parent or guardian. We don't knowingly collect children's data without parental consent. If you believe a child has shared data with us, contact us and we'll delete it.

Our site may link to other sites such as Instagram, Facebook or YouTube. We're not responsible for their privacy practices, so please read their policies.
